Never operate the App while driving. Stop safely before you look at or touch your phone.
1. Not an electronic logging device
DutyPal is not an electronic logging device (ELD). It is not connected to the vehicle's engine and is not on the Federal Motor Carrier Safety Administration's (FMCSA) list of registered ELDs (49 CFR 395.22).
2. When an ELD is required
A driver who must keep records of duty status must use a registered ELD unless an exception applies (49 CFR 395.8(a)(1)(ii)), for example:
- a log is needed on no more than 8 days in any 30-day period,
- certain driveaway-towaway operations,
- the vehicle's engine is older than model year 2000.
Long-haul driving outside these exceptions requires an ELD. DutyPal cannot be used in its place.
3. Short-haul exception
For drivers operating under the 150 air-mile short-haul exception (49 CFR 395.1(e)), DutyPal helps you track whether you stay within its conditions. Whether the exception applies to you, and whether you meet its conditions on a given day, is for you and your motor carrier to determine.
4. Calculations, GPS and automatic detection may be wrong
DutyPal's warnings and calculations - GPS distances, detected duty status changes, remaining driving, shift and cycle hours, break and rest status - are estimates. They may be wrong, incomplete or late, for example because of:
- weak or missing GPS signal, tunnels, urban canyons,
- device hardware and operating system limits,
- battery saving settings that stop the App in the background,
- incorrect or missing manual entries, profile or settings,
- differences in how rules are interpreted or applied to your operation.
Always review your records and correct them where needed. Do not rely only on the App's clocks and warnings when deciding whether you may drive.
5. Do not use the App while driving
Do not read, type on or otherwise operate DutyPal while the vehicle is moving. Federal rules prohibit drivers of commercial motor vehicles from texting (49 CFR 392.80) and from using a hand-held mobile telephone (49 CFR 392.82) while driving; at most, a single touch of a phone mounted near the driver is allowed. State and local laws may be stricter.
DutyPal detects driving automatically so that you do not need to touch the phone on the road. If the App shows a question or notification while you are driving, ignore it until you are safely and lawfully parked. Set up and review your logs only when stopped.
You are solely responsible for operating your vehicle safely. The developer is not liable for any accident, injury, damage or violation resulting from use of the App while driving.
6. Your responsibility
You and your motor carrier remain responsible for complying with the hours-of-service rules and for keeping true and correct records (49 CFR 395.8(e)), including retaining them and presenting them to enforcement officials when required.
Before you start using DutyPal, the App asks you to sign a statement confirming that you understand this.
7. Not legal advice
Information in the App and on this website is provided for general information only and is not legal advice. Rules and their interpretation change; check current FMCSA regulations, state rules and your carrier's policies.
8. Limitation of liability
To the maximum extent permitted by law, the developer of DutyPal is not liable for fines, penalties, out-of-service orders, violations, lost income or business, incorrect calculations or records, data loss, or any indirect or consequential damages arising from the use of the App. See also the Terms of Use.
9. Changes
This Disclaimer may be updated. If the in-app statement changes, the App will ask you to sign it again.
