These Terms of Use ("Terms") govern your use of the DutyPal mobile application ("DutyPal", "the App"), provided by Firma Usługowa Jarosław Jezierczak, Ul. Poniatowskiego 249C, 34-700 Rabka-Zdrój, Poland ("we", "us"). By downloading, installing or using the App, you agree to these Terms.

1. What DutyPal is

DutyPal is a Hours of Service logbook assistant for commercial drivers in the United States. It helps you record duty status, see remaining driving, shift and cycle time, track short-haul conditions and prepare reports.

DutyPal is not an electronic logging device (ELD) and does not replace one where an ELD is required. Please read the Disclaimer, which is part of these Terms.

Before using the App you sign, by typing your name, a statement that DutyPal is not an ELD and that you remain responsible for your hours of service and records. You agree that this typed name is your electronic signature. The App stores the signature, its date and the statement version on your device.

Your data is stored on your device. You are responsible for making backups of your records, for example with the App's encrypted backup file, and for keeping the backup password safe. We cannot recover lost data or passwords. How we handle information is described in the Privacy Policy.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or business purposes in accordance with these Terms. The App and its content remain our property.

The App is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties, express or implied, including that the App will be uninterrupted or error-free, that its calculations, GPS distances or automatic detection will be accurate, or that its use will ensure compliance with any law or regulation.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for accidents, injury or damage caused by using the App while driving, fines, penalties, out-of-service orders, violations, loss of income, profits or business, incorrect calculations or records, data loss, or any indirect, incidental or consequential damages arising from the use of, or inability to use, the App. Where liability cannot be excluded, our total liability is limited to the greater of (a) the amount you paid for the App in the 12 months before the claim, or (b) USD 100.

We may update the App and these Terms. The current Terms are always available on this page. Material changes will be indicated by a new "Last updated" date and, where appropriate, in the App. You may stop using the App at any time by uninstalling it and cancelling any subscription.

11. Governing law

These Terms are governed by the laws of Poland. This does not deprive you of the protection of mandatory consumer protection laws of the country or state where you live.

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
